North Coast Inter-Tribal Children's Court Pilot Project

POSITION:

Children's Tribal Court Judge

SALARY:

$30,000 to 49,000/year (depending on Experience)

STARTING DATE:

Immediately



POSITION NARRATIVE: The Children's Tribal Court Judge will report to the Board of Directors of Two Feathers Indian Child Welfare Program (ICWP) which is composed of one member from each of the consortium tribes (Bear River Band of the Rohnerville Rancheria and Big Lagoon Rancheria). The Children's Inter-Tribal Court Judge shall be directly responsible for establishing the North Coast Inter-Tribal Children's Court, writing the tribal children's code, court rules and procedures, and negotiating a state jurisdictional agreement for assuming jurisdiction over juvenile dependencies, including an agreement for board and care for children in foster care. The judge will have ongoing responsibility for overall administration of the court. The judge must write the children's Tribal court bench manual and utilize that manual to train other tribal children's court personnel to hear minor-in-need-of-care cases.

POSITION RESPONSIBILITIES: The Judge will be responsible for implementing the North Coast Inter-Tribal Children's Court Pilot Project pursuant to the guidelines, and ultimately meeting the goals and objectives of the project. The hob duties include: establishing the Inter-Tribal Children's Court; drafting court rules and procedures; drafting a bench manual; coordinate and conduct meetings with local and state agencies to assume jurisdiction of juvenile dependencies; draft and negotiate a state-tribal agreement for assumption of jurisdiction; draft and negotiate a funding agreement with the state social services for the payment of tribal foster homes; draft agreements with local tribal service providers to provide family reunification services; hold minor-in-need-of-care hearings (juvenile dependencies); oversee overall administration of the court; supervise the court clerk; and train other tribal court personnel to set up a children's court.

QUALIFICATIONS: Must be a currently practicing children's court judge or a licensed attorney familiar with the Indian Child Welfare Act, juvenile dependency and Indian Jurisdictional law (Public Law 280 issues). Must be willing to relocate during the first year of the project. Indian preference will be given pursuant to the Indian Preference Act of 1934. Verification of proof of eligibility for Indian preference must be submitted to the Director.
